Agreement to Terms

By accessing or using Hiro.host (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you (either as an individual or on behalf of an entity) and Hiro.host ("we," "us," or "our").

Hiro.host is a file hosting and website publishing platform that allows you to:

  • Upload files (PDFs, images, documents) and share them via a public URL
  • Host static websites by uploading ZIP files
  • Use free subdomains on hirohost.site
  • Connect custom domains to your projects
  • Protect content with password authentication

Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding contracts
  • Provide accurate registration information
  • Not have been previously suspended or banned from the Service

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration and Security

Account Creation

You must create an account to use most features of the Service. You agree to:

  • Provide accurate and complete information during registration
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities that occur under your account

Account Responsibility

You are responsible for all content uploaded and activities conducted through your account.

Subscriptions and Billing

Subscription Plans

We offer free and paid subscription plans with different features and limits. Details are available on our pricing page.

Billing

  • Paid subscriptions are billed in advance on a recurring basis
  • You authorize us to charge your payment method on each billing cycle
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice for existing customers

Free Tier

  • The free tier includes limited projects and storage
  • We reserve the right to modify free tier limits with notice
  • Free tier projects may display advertisements at our discretion. We reserve the right to introduce, modify, or remove ads on free tier projects at any time without prior notice. Upgrading to a paid plan removes all advertisements

Cancellations

  • You can cancel at any time through your account settings
  • Cancellations take effect at the end of the current billing period
  • Upon cancellation, your projects will be downgraded or deleted according to free tier limits

Acceptable Use Policy

Permitted Use

You may use the Service to host and share legitimate content that you have the right to distribute.

Prohibited Content

You may not upload, host, or share:

  • Illegal content or content that facilitates illegal activities
  • Malware, viruses, or harmful code
  • Content that infringes intellectual property rights
  • Content that violates privacy rights without consent
  • Hate speech, harassment, or discriminatory content
  • Sexually explicit content involving minors
  • Content promoting violence or terrorism
  • Phishing pages or fraudulent content
  • Spam or deceptive content

Prohibited Activities

You agree not to:

  • Violate any laws or third-party rights
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service

Enforcement

  • Create backups and perform technical operations
  • Display Your Content to visitors of your projects

Your Responsibilities

You represent and warrant that:

  • You own or have rights to all content you upload
  • Your Content does not violate any laws or third-party rights
  • You have obtained necessary consents for any personal data in Your Content

Public Content

Content you publish through the Service is publicly accessible unless you enable password protection. You are responsible for ensuring you have the right to make content public.

Content Removal

You can delete your content at any time through your account dashboard. We will remove deleted content from our servers, though backup copies may persist temporarily.

Intellectual Property

Our Rights

The Service, including all software, designs, and branding, is owned by Hiro.host and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.

Trademarks

Hiro.host and associated logos are our trademarks. You may not use our trademarks without written permission.

Service Availability

Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may experience:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency maintenance without notice
  • Interruptions due to circumstances beyond our control

Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

Third-Party Services

The Service integrates with third-party services (Stripe for payments, Cloudflare for CDN). Your use of these services is subject to their respective terms. We are not responsible for third-party service availability or practices.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • Your Content will not be lost or damaged

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Exclusion of Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, revenue, or data
  • Business interruption
  • Loss of goodwill

This applies regardless of the legal theory and even if we were advised of the possibility of such damages.

Cap on Liability

OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF:

  • The amounts paid by you in the 12 months preceding the claim, or
  • $100

Exceptions

Some jurisdictions do not allow limitation of certain damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Hiro.host from any claims, damages, and expenses arising from:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of any laws or third-party rights

Termination

Termination by You

You may terminate at any time by canceling your subscription and deleting your account.

Termination by Us

We may suspend or terminate your access if:

  • You breach these Terms
  • Your account poses security risks
  • You engage in fraudulent or abusive activity
  • Required by law

We may also terminate with 30 days' notice for any reason.

Effects of Termination

Upon termination:

  • Your right to access the Service ceases
  • Your projects and content will be deleted
  • You remain liable for any fees incurred prior to termination

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending you an email notification

Your continued use after changes take effect constitutes acceptance.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at [email protected].

Jurisdiction

Any disputes that cannot be resolved informally shall be resolved in the courts located in Delaware, USA.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hiro.host.

Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any provision does not constitute a waiver.

Assignment

You may not assign these Terms without our consent. We may assign these Terms at any time.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
